Incredulous Findings Concerning Patient Care at Belhaven Nursing and Rehabilitation Center
A survey conducted on the level of care provided to patients admitted into the Belhaven Nursing and Rehabilitation Center, by the Illinois Department of Health, showed that patients experienced periods of poor care and abuse during their stay. The nursing home attorneys of Rosenfeld Injury Lawyers LLC reviewed the survey reports of ProPublica and discovered the following episodes which could be construed as nursing home negligence:
- Failure to investigate allegations of abuse: “Social service note dated 10/02/09 states E10 (Social Service Assistant) spoke to State Guardian regarding R10’s accusation that staff were hitting her. E10 wrote in note that she spoke to R10 and R10’s nurse. E10 also wrote that R10 could not remember when it supposedly happened. R10 stated she wanted to go to another nursing home. E10 was asked if she knew if this allegation was investigated. E10 stated she did not know.”
- Failure to complete comprehensive pain assessments: “On 11/16/09 during initial tour accompanied by E3 (nurse), R3 observed in bed on isolation status [MEDICAL CONDITION] (methycillin resistant staphylococcus aureus) of Nephrostomy tubes according to E3. R3, who is recently readmitted to the facility on [DATE] is complaining of vaginal bleeding with pain and, requesting to go to the hospital. On 11/18/09 at 10:05am, R3 is now residing in room [ROOM NUMBER]. Accompanied by E7 (nurse), R3 was interviewed again and states, “It’s pain when I urinate. I don’t want to be a pest.” As the resident lay in bed, an inspection of the residents body shows a [MEDICATION NAME] patch noted to the right chest area dated 11/18/09, 6:00am and; another [MEDICATION NAME] patch taped to the right upper forearm area dated 11/13/09 with the initial “RC.” At that point, E7 states, “No, both of the patches should not be on.” A review of the resident’s clinical record indicates (3) pain assessment records, one dated 09/17/09. The pain assessments are not completely filled out and, there is no evidence of any assessment to address R3’s comfort and pain as it relates to the uterine and [MEDICAL CONDITION].”
- Failure to take measures to prevent the development of pressure sores: “On 11/17/09 at 9:50 AM, surveyor observed R14 sitting in a reclining chair in his room. There was no pressure reduction mattress noted in the room. R14 requested to be put back to bed because his back hurt. At 11:20 AM, surveyor requested to do a wound check on R14. E5 (RN) stated, “the wound is healed”. At the time of this observation, R14 was found soaked with urine through his sweat pants on to the reclining chair seat. There was no gel cushion under R14’s buttock. On 11/17/09, surveyor could not find documentation in R14’s record or facility wound treatment book regarding R14’s treatments or measurements of the left buttock wound. On 11/18/09 the facility provided documentation that the wound had healed on 11/15/09.”
- Failure to ensure residents are safe from serious medication errors “During medication pass on 11/17/09 at 9:15a.m. E7 (Staff Nurse) was observed to dispense [MEDICATION NAME] coated aspirin 81mg and [MEDICATION NAME] 50mg for R32. E7 stated she had to take R32’s blood pressure which was 141/52. E7 stated at this point she was going to hold R32’s blood pressure medications of [MEDICATION NAME]., [MEDICATION NAME] and [MEDICATION NAME]. E7 stated she planned to retake R32’s blood pressure and inform physician. E7 was then observed to dispense the aspirin and [MEDICATION NAME] to R32. Medication Administration Record [REDACTED]. There was no pulse recorded for 11/14/09, 11/15/09, 11/16/09, 11/17/09 or 11/18/09. This was observed with E7.”
- Failure to assess and determine cause of falls and to put in place interventions to prevent further falls: “R3 fell on 7/10/10, 7/13/10, 7/27/10, 8/22/10, 11/11/10, and 11/30/10. 11/11/10 at 6:30 AM – R3 was observed on the floor with seat belt and clip alarm dislodged. Incident report did not mention what was done to prevent recurrence. R3’s 11/11/10 nurses notes at 6:30 AM indicated that R3’s chair alarm and seat belt was unfastened. R3 sustained swelling to the right eye. Per R3’s initial fall investigation dated 11/11/10, R3 released the clip alarm and seat belt and attempted to stand from her wheelchair. To prevent recurrence, the seat belt was discontinued and alarming seat belt was added. 11/30/10 at 7:30 AM – In the hallway, R3 was observed on the floor lying on her right side and with complaint of right hip pain. R3 was sent to the hospital for evaluation. R3 sustained right hip fracture.”
