The Concerning Findings Regarding Patient Care at the Aria Post Acute Care

According to data from nursing home surveys conducted by the Illinois Department of Health other agencies, there have been numerous episodes of poor patient care at Aria Post Acute Care which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to monitor residents at risk for elopement: “R2 is a dementia resident and is an unsafe wanderer. He eloped from the facility for several hours, this is a potential to receive serious harm. R2 was housed on a locked unit. There is no indication whether R2 was wearing an electronic device, which was a written order by the director of nurse per family request. When located, R2 was not found wearing such a device. These failures resulted in R2 leaving the facility without staff knowledge on 5-16-10 approximately at 11am. The temperature that day was 50 degrees. R2 was found 10 hours later under a viaduct near a busy intersection by the local fire department. R2 was reported to not be wearing an electronic monitoring device. The facility failed to adequately supervise R2, a new admit, who left the facility. The facility failed to accurately assess R2 who has dementia .The facility failed to ensure that R2 was wearing his electronic monitoring device. Staff interviewed stated that no alarm was heard, however doctor’s order stated that an electronic sounding device be placed on R2, 5-13-10.”
  • Failure to provide interventions to treat pressure sores: “Based on observation, interviews, and record review, the facility failed to ensure that appropriate pressure-relieving cushion devices were provided to treat pressure ulcers for R5 and R6. The lack of appropriate pressure-relieving cushion device had resulted to R5’s [MEDICAL CONDITION] pressure ulcer on the left buttock area. Z1 (wound doctor) stated that due to [MEDICAL CONDITION], R5 has no sensation and because R5 spend too much time sitting without the pressure-relieving cushion, R5 is subjected to constant pressure without relief. Z1 also stated that the pressure-relief wheelchair cushion, if used, could have avoided R5’s [MEDICAL CONDITION] pressure ulcer on the left buttock.”
  • Failure to prevent avoidable falls: “This failure resulted to R6’s fall incident on 9/1/09. R6’s wheelchair had tilted backward because of the uneven floor level in the facility’s designated smoking area. On 10/15/09 at 2:30 P.M., R6 stated that the floor level in the patio smoking area is not level. R6 also added that he fell on [DATE] because he tilted backward with his wheelchair when he was on his way back inside the facility from the patio smoking area. R6 also indicated that the uneven floor level had made his wheelchair in an inclined position and had made his wheelchair to tilt backward. Further added by R6 that there was no anti-tipper device that was attached to this wheelchair which could also possibly help prevent the wheelchair to tip backward.”
  • Failure to properly transfer residents needing assistance: “E1 provided a copy of E18 ‘ s, (CNA) employee report dated 11/22/10 documents the following, ” Resident in room [ROOM NUMBER]-a sustained a fracture of the left lower leg due to staff failure to use proper lift as noted in patients record and in the room. Failure of an employee to follow the reasonable instructions of her/his supervisor – Discharge.”
  • Failure to ensure residents are free from abuse by staff members: “R2 was interviewed in her room on 10/02/09 at 3:30 PM. R2 was alert and oriented. R2 stated: “E8 is trying to get me out of here as soon as possible… Yesterday (10/01/09) at the nursing station, E8 told me he was going to get rid of me. I told him to go to hell. E8 kept on in front of the nurses. I cussed him, and he kept going on. I went to therapy and he was up there, and he called me a big ball,
    because I’m fat. I guess E4 (director of physical therapy) heard it. E7 (therapy aide) heard him. They were shocked. They told me they always have problems with him… While he was there, I felt threatened… E8 just bent over into my face and told me he was going to get rid of me as soon as they could. E1 (administrator) told me he was not supposed to say that… The therapist tried to get him to leave me alone and let me calm down. But, E4 would not stop.” The director of physical therapy (E4) was interviewed on 10/02/09 at 4:10 PM. He (E8) kept egging her on… His (E8’s) behavior was unprofessional… He (E8) should have stepped out (of the room). All of us have been trying to get her to participate, so the insurance company will not discharge her. The manner in which he said it could be offensive… Her sister was worried he (E8) might physically hurt her and they wanted to call the police. …I never have seen R2 get this upset before.”
