This is in response to a 1/12/2011 incident reported to the facility’s Director of Nursing alleging abusive behavior involving two CNAs. One incident involved a CNA allegedly telling a resident “she was crazy and ‘threw’ the resident into her wheelchair.” In a separate incident, a CNA “allegedly yelled at [another resident] for wetting his bed.”
- Failure to Provide Residential Environment Free of Physical Restraints:
In a summary statement of deficiencies dated 12/12/2006, during an annual certification survey, notations were made of the facility’s failure “to assess for the use of a restraint device, to obtain a consent and a physician’s order for the use of the device.” This notation was made in response to a December 2006 incident of the use of a trunk restraint even though the individual’s “Resident Assessment Protocols (RAPS) show no review for the use of a trunk restraint.”
In addition, the “2006 Physician’s Order Sheet did not show an order for the use of the restraint device.” This is in direct violation because there was “no consent form for the use of the restraint device in [the resident’s] medical record or the facility restraint monitoring binder.”
