• Failure to give proper treatment to promote healing of pressure sores: “The record depicts the facility failed to complete a weekly inspection according to R1’s plan of care, and on 8/17/09, 12 days from the 8/5/09 weekly progress note: Measurement increased- length 15.5 cm width 4.0 cm.- 70% pink wound bed; 30% darkened (brown) superficial; O (Zero) slough. The record does not reflect Z1 (R1’s physician) contacted until 8/1/09; yet the record continued to depict changes in the right heel pressure sore site. Z1 interviewed 12/7/09, and stated,” If they called me with the changes I would have sent resident to hospital, or come to see him.”

• Failure to properly dispose of expired medications: “During observation of the 2nd floor Medication Room with E7 (Registered Nurse) on 5/18/11 at 3:10 PM, the following was found: Docusate 1 Plastic container with 1000 gels – expired 4/11. According to E7 on 5/18/11 at 3:30 PM, all staff nurses are supposed to check for medication expiration and label all opened medications.”

• Failure to report injuries of unknown origin: “R17 was observed on initial tour of the facility on 6-12-12 between 9:15AM and 10:00AM by 3 surveyors with a blackened left eye while R17 was sitting in her wheelchair on the first floor. Review of the facility’s incident log and abuse allegations contained no information that the facility notified the regional officials of the injuries of unknown origin for R17. Review of R16’s incident report dated 4-30-12 notes on 4-28-12 complaints of more pain in her groin area with minimal pain relief from pain medication and non-pharmaceutical interventions. MD was notified and ordered to send R16 out to the hospital for emergency evaluation. Z1 (Nurse Consultant) explained on 6-13-12 that R16 and R17 had incidents and there was no abuse substantiated and this is why we did not sent it to the officials.”
