The Concerning Findings Regarding Patent Care at the At Alden Lincoln Rehab & Healthcare Center

A survey conducted by the State Department of Health and diverse private health inspection firms un-earthed some episodes of poor patient supervision and inadequate patient transportation which led to the patient falling. The survey conducted by ProPublica—a private inspection firm—was reviewed by our nursing home attorneys in Rosenfeld Injury Lawyers LLC and episodes of poor supervision which could be construed as nursing home negligence were found:

  • Failure to give treatment to maintain or increase range of motion: “ During three days of the survey, 09/07/10, 09/08 and 09/09 R2 observed in bed with bilateral contractures of the upper and lower extremities. The residents’ right leg is noted to be resting on the left thigh with nothing in between them. But, wearing bilateral heel protectors. R2 is in a fetal position. At 10:40am on 09/07/10 during the initial tour accompanied by E2 (director of nurses), when E2 observed and was asked about the contractures to the lower extremities, E2 responded by stating, “If R2 is not in a restorative program, R2 should be right away.” On 09/14/10 at 12:55pm, surveyor interviewed E5 (restorative nurse) about providing some sort of treatment measures to R2’s lower extremities. E5 states, “No, there is no MD order not to apply splints to lower extremities. We were placing pillows between the legs. The doctor mentioned he didn’t want the splints last week. No, there is no assessment for the use of splints.””
  • Failure to develop complete care plans to meet each resident’s needs: “R2 is an [AGE] year old with diagnosis which include Dementia and [MEDICAL CONDITION]. The resident observed three days of the survey 09/07/10, 09/08 and 09/09 in bed with an indwelling catheter in place. And on 09/09, after surveyor accompanied by E8 (nurse aide) and E9(nurse) visually examined the residents body, a reddened penis with drainage and a small raised red area on the foreskin area was noted. E9 (nurse) contacted the physician and orders were written to apply Silvadene to what the physician described as a penile lesion. And the resident requires extensive care by staff with personal hygiene/grooming. When the care plan dated 08/19/10 was reviewed, the indwelling catheter with catheter care, the penile lesion treatment and personal hygiene/grooming issues are not addressed.”
  • Failure to report injuries of unknown origin to the State: “Review of nurses notes as written: 6/29/10 3:45PM Paged by charge nurse on floor to come to 2nd floor. Stated resident fell and hit his head.3:48 Found resident on floor between bed B and bedside table by window. Resident stated he fell and doesn’t (does not) remember how. Blood noted on pillow under head and on floor behind head. 4:00 911 around x (times) 2 attendants. V/S B/P 168/104, 88 18. These nurses notes also indicated that the Ambulance had to decide to take R3 to the nearest hospital emergency room, instead of the proposed hospital due to distance. Interview of E1 (Administrator) on 9/14/10 re: R3’s unwitnessed accident fall stated that R3 tends to reach for things over and that he has been assessed for siderails as an enabler. Surveyor then discussed that according to their investigation report R3’s siderails was down and not up during the incident. Chart record reviews on R3 revealed that R3 needed supervision under Cognition and requires total assistance in ADL’s (Activities of Daily Living). Side Rail assessment dated [DATE] indicated that R3 had history of falls in the last three months and one side rail full length will serve as an enabler. As a result of this failure the facility did not report to the state agency that this resident had an unwitnessed fall and a critical hypertensive crisis in which the resident had to be sent out and transported to the hospital emergency room for evaluation. ”
  • Failure to provide supervision to prevent avoidable accidents: “10/12/10 5:05A.M. R11 was found by E11 ( Certified Nurse Aide CNA ) on the floor next to his bed.(room [ROOM NUMBER]) . A bed alarm had activated. R11 sustained a laceration to the right side of his head requiring 5 staples from the hospital. 10/25/10 at 1:35AM R11 was heard yelling by the door of his room . E10 ran towards R11 as he fell to the ground. R11 was sent to the hospital .R11 sustained a Right wrist fracture. 7/21/11 at 3PM R11 was found on the floor in the dining room by E17( CNA). R 11 was on his left side next to his wheelchair. The chair alarm had failed to go off. R11 sustained a 4 to 5 Cm laceration to his left side of forehead with a hematoma underneath. R11 was sent to the hospital. ”
