Federal nursing home regulations require that every nursing facility install active call lights and keep them in proper working order to ensure that residents have a way to immediately notify staff members that they need help or assistance. Unfortunately, many nursing facilities lack adequate staff members to promptly respond to every resident’s call light, which could place the resident’s health and well-being in jeopardy. Sadly, the Shorewood elder abuse attorneys at Rosenfeld Injury Lawyers have handled many cases where a resident fell while attempting to go from the bed to the bathroom unassisted because the nursing staff failed to respond to the call light.

Shorewood Nursing Home Resident Safety Concerns
Every year, the federal government and the state of Illinois routinely update their databases to reflect newly opened investigations, filed complaints, health hazards and safety concerns in nursing facilities all across the United States. The information is then posted online on numerous websites including Medicare.gov. Many families use the results found in the star rating summary system to make the best-informed choice before deciding where to place a loved one in their community who requires a high level of nursing care.
Currently, Alden Estates of Shorewood maintains an overall three out of five available star rating compared to all other facilities nationwide. This includes five out of five stars for quality measures, three out of five stars for staffing issues and two out of five stars for health concerns. Our Shorewood nursing home neglect attorneys have found numerous safety concerns involving this facility that include:
- Failure to Reasonably Accommodate the Preferences and Needs of Every Resident
In a summary statement of deficiencies dated 10/09/2015, the state investigator noted the facility’s failure “to answer call lights in a timely manner to accommodate a resident’s needs.” The investigator noted Alden Estates of Shorewood directly affected four residents at the facility “reviewed for call light response time.”
The failure was first noted at 10:30 AM 10/07/2015 when a resident “describe the wait for a call light response at about 20 to 30 minutes [… stating that] ‘If a patient is having [medical emergency], it would be too long the patient would be dead by the time they [the nursing staff] comment. I am claustrophobic! The first time I got here, I requested to be taken to the bathroom, they left me there alone and closed the bathroom door. I pulled my call light, no one came, so I started screaming. My room is all the way to the end of the hallway, they probably did not hear me screaming, but I have my light too, I waited for 30 minutes. The motto here is I will be back but they do not [return]. I felt helpless and it is a bad feeling!’”
The investigator interviewed two other residents at 11:00 AM on the same day who stated that “the staff is slow in answering call lights.” One resident claimed that their roommate “was taken to the bathroom at night and was left there for an hour [… stating] ‘I cannot help her [my roommate] because I got a broken arm and she cannot walk by herself because of her surgery in her leg (a melanoma reconstruction (surgical) on the right lower extremity).” The roommate added that “it was upsetting. I waited and waited and it is hard to sit on a toilet for an hour.”
- Failure to Provide Every Resident Environment Free of Accident Hazards and Risks and Provide Adequate Supervision to Prevent Avoidable Accidents
In a summary statement of deficiencies dated 10/09/2015, the state investigator noted the facility’s failure “to provide supervision to [a resident] identified as being at risk for falls by failing to monitor the resident during toileting.”
The investigator noted that the failure involved a resident at the facility who previously have a stroke. A nurse assisted a Certified Nursing Assistant in transferring the resident to the bathroom to be placed on the toilet and then left alone with the door closed and the “call light cord draped with a trash bag attached to the end of the cord across the resident’s lap prior to leaving the washroom.
Even though the resident’s wife remained outside the closed door, the nurse and CNA did not remain in the room. In less than 10 minutes, the nurses for the resident’s “spouse calling for help, and went to find [the resident] on the bathroom floor.”
